New Jersey's top prosecutor steps down in the wake of appeals court disqualifies her appointment.
The former personal attorney for Donald Trump has left her position as the US Attorney for New Jersey. This follows a judicial decision that challenged her legal standing to hold the office.
Official Departure
The head of the Justice Department, the Attorney General, confirmed her stepping down on the start of the week. She commented that the court's "flawed" ruling made it impossible for the official to perform her duties.
"But do not mistake following the order as giving up," she wrote. "This battle will now extend throughout America."
Court Ruling
Habba's exit comes a week after a US appeals court found that she had been acting without proper authority as the federal prosecutor. This decision is expected to impact many legal proceedings in New Jersey.
The judicial panel ruled that a interim role that skirted the advice and consent of the Senate ran afoul of the statute on vacant positions.
Future Role and Reaction
Bondi said that she will stay on at the justice department as a senior adviser. She will seek further review of the disqualification, aiming for a overturned decision.
In a statement, she wrote that judges "must not countermand the executive's selection of lawyers tasked with executing the fundamental role of the presidency of enforcing the law."
Accomplishments Cited
Bondi praised the prosecutor's work and said that while she was in charge, the city of Newark saw a significant drop in crime. Additionally that the Camden experienced its first summer in 50 years without a homicide.
Connection to Donald Trump
Habba, 41, was initially recruited to Trump's personal legal team in 2021. She later represented her client in his New York criminal case in New York last year, leading to his conviction on multiple felony counts of falsifying business records.
Before her appointment to the role of US Attorney, Donald Trump had announced he was selecting her as his senior adviser if re-elected, calling Habba as "unwavering in her loyalty" and a "tireless advocate for justice".
